Family of Kerala nurse facing death penalty in Yemen moves Delhi HC for help

he family of an Indian nurse facing the death penalty in Yemen has moved the Delhi High Court seeking orders to the Indian Government to intervene in her case through diplomatic channels.
The plea filed by the Save Nimisha Priya International Action Council states that Nimisha was held guilty of murder after she allegedly gave sedatives to a man who hid her passport and kept her as a slave in Yemen.
Nimisha, a nurse from Kerala, had been working in Yemen when travel to and from the country was banned in 2016 due to the Civil War. Her husband and daughter returned to India in 2014, but she couldn’t due to her job. She was accused of killing a Yemeni national in July 2017.
On March 7, the Court of Appeal in Yemen upheld the death sentence imposed on Nimisha.
Nimisha had alleged abuse and torture by Talal Abdo Mahdi. According to her statement, she gave him sedatives so that she could search for her passport and return to India. But things blew out of proportion as the man died. Nimisha then allegedly cut his body into pieces and dumped it in a water tank.
The plea before the Delhi HC claims that the deceased physically and financially abused her, and locked away her passport so she could not return to India. In addition, he misrepresented himself as her husband to the Yemeni authorities, due to which she couldn’t get any aid from them.
The plea, filed by advocate Subhash Chandran KR, further said that due to the socio-political situation in Yemen, travel to Yemen is not allowed and there is no way for her family or well-wishers to visit Yemen and pay blood money to secure her release.
The petition has sought court orders from the HC to the Indian Ministry of External Affairs (MEA) to "facilitate diplomatic interventions as well as negotiations with the family of the victim on behalf of Nimisha Priya to save her life by paying blood money as the law of the land in a time-bound manner."
If the government is not able to secure an appeal, the plea has sought permission to "collect and send money" to Yemen to pay "blood money" to the family of the deceased, so that she can avoid the death penalty in Yemen. At present, financial transactions with Yemen are restricted by the Indian authorities.
In their plea, the family has also stated that they have sent representations to the government but have not received any response so far.
