Woman complaints to SP against mental torture by husband and in laws

Udupi : A woman called Jamsheena A K originally from Kerala now presently residing in Athradi of Udupi district complained against her husband to the Superintendent of Police, Udupi district that the physical and mental torture, extortion of money snatching of gold and jewellery and ruining her life and bringing about misery to her and her old mother by the husband Mr Mohamed Shareef Ali.

 

 

Speaking to media persons during a press meet on Tuesday, March 5, Dr Ravindranath Shanbhag, President of Human Rights Protection Foundation here said that Jamsheena A K is the second daughter of Late Jaleel A K of Tellicherry, Kerala was married to Mohd Shareef Ali S/o Moosa Abdul Khader residing in Karamballi village Udupi on 3rd January 2013 at Rahmaniya Juma Masjid at Doddanagudde. Right from the time, they accepted this alliance, rigorous conditions were put by her husband and her in laws. A dowry of at least 240 grams of gold jewellery was demanded by her in laws. Her parents had to arrange for the gold.

As per the complaint lodged with SP, she said, within four months of the marriage, they forcibly took away all the gold ornaments worth about eight lakhs at that time, on the pretext of buying a lorry for transportation of fish. When she resisted parting with the gold they hit her very badly and took away the gold jewellery.

She said her husband never seriously engaged himself in any gainful employment. Even after buying the lorry from the money received by sale of her gold, it was not used properly by her husband. Instead it was given for rent to some other driver. Ultimately the lorry was sold by her husband but she did not get her money or jewelry back.

 

 

Every now and then her husband was demanding further money from her mother from her, physical assault on her was a never ending daily affair.On any pretext, she was being assaulted not only by her husband but also by her mother in law. Everyday he was returning home fully drunk and then for any and every reason hitting her violently. Once they sent her to her mother’s place to bring more money. Her mother could not arrange for money for about a month. He insisted upon payment of at least Rs50,000 before taking her back. Her mother was forced to pay the money demanded. Thus, he had collected nearly Rs 6 lakhs from her mother during the last 5 years.

In September 2014 her husband got job in the Gulf. When he went to gulf for the job, her mother had to arrange for travel and other incidental expenses. There he did not engage himself in any gainful employment for long and returned to India in a short time. He never sent a money to her during his brief stay at gulf.

 

 

During his stay in gulf, his mother was forcing her to borrow money from whatever sources available. On 13.08.2015, she was forced to borrow money from Muthhoot finance and gave the to his mother, while taking this loan the finance company insisted that this loan application should have her husband signature along with her. At the time of this transaction her husband was in gulf. And she was hopeful that loan would not be sanctioned. Later she come to know that her husband’s signature was forged by someone else at the instance her mother-in law to avail this loan. Further, on 3.11.2015, she was forced by her mother- in law to further borrow Rs. 50000 from the Fishermen Society, Malpe. On 7.04.2016, once again a loan of Rs 30,000 was taken from Muthhoot Finance in her name. She have no idea whether these loans have been repaid or not.

 

 

In June 2015, she met with an accident at Kaup and was hospitalized at Adarsh Hospital at Udupi. Later, she received a compensation of Rs 35000 from the Insurance company. Even though she had a SB account with Vijaya Bank Telicherry, she was forced to open another account in Vijaya Bank Udupi and the pass book as well as ATM Card was retained by mother in law. On 5.8.2016, he returned from the gulf. All the insurance money was taken through her ATM card for his extravagance and booze.

In March 2017, a job was arranged at Dubai this time by her maternal uncle and her husband insisted upon her accompanying him. For this visit too funds were arranged by her mother in law by borrowing. After spending large amount for this trip, they returned to India within three months after his working in a supermarket for just a week.

On 11.07.2007, again he forced her mother to pay him Rs one lakh to buy another lorry. Further several loans were taken from various finance companies since the amount was not enough to buy lorry. Even this lorry was not used for much commercial use by her husband.

 

When her mother exhausted all her resources, her husband tried another trick. On 11.04.2018 she was forced to join a group of ladies to borrow from one Bharath Finance company, since the loan was given only to ladies. The money Rs 26845 this received was immediately withdrawn by ATM card without even informing her. She do not even know where the office of Bharath finance is situated, how much total loan has been taken and how much has been returned.

 

Sometime in the last quarter of 2017, her husband asked her to sign several blank cheques of the account with Vijaya Bank, K M Marg Udupi without informing her the purpose. She politely declined to do so since she did not know the balance in her account. He got wild and assaulted her so badly that she was forced to sign several blank cheques. She do not know even now to whom he had issued them.

 

In mid December 2018, her husband and in laws together assaulted her and threw her out of their house because she could not get more money from her mother. She then stayed with her sister in Athrady for a week. Then one Mr Aboobacker, a senior member of our society, tried to help her and requested her husband to stay separately with her away from his parents’ house. He agreed and a small house was taken on rent in Athrady.

Once again on 12th February 2019, at 4 pm her husband again assaulted her. This time she did not know why she was being tortured. Same day, she escaped and came to her sister’s house. The same night at 8 pm her brother – in law gave a written complaint to Manipal Police station. Next day he was called to police station and police officer tried to patch up. Since several issues were involved she wanted proper explanation for the ill treatment, assault and mental torture by her husband and his family. The assault on her was so severe that she had to go and get treatment at District hospital, Udupi for treatment.

Luckily she got the pass book of her savings account before leaving the house. She got the passbook updated by the bank on 21st February, she observe that a cheque numbered 75154028 has been returned unpaid by Bank on 4th December 2017 and cheques nos 75154038 and 75154035 too were returned unpaid on 25th April 2018 and 27th April 2018 respectively.

She was totally unaware of the present position of the other signed cheques and whether he has given these cheques to anyone. But the fact that he has taken so many blank cheques from me forcibly in itself is causing mental torture to me. Please note that she had absolutely no desire to sign such cheques but the torture she was subjected to.

She was filing this complaint against her husband and her in laws to get protection from such unbearable torture under the provisions of the law applicable. Meanwhile she was hospitalized and have been diagnosed as a diabetic patient.
